- These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and the Ahmaud Arbery Foundation (“Foundation,” “we,” “us,” or “our”) regarding your access to and use of the Foundation’s website, including its e-commerce store (the “Store”).
- By accessing or using any part of the site, purchasing merchandise, or making a donation, you acknowledge that you have read, understood, and agree to be bound by these Terms and the associated Privacy Policy. - The Ahmaud Arbery Foundation is a registered 501(c)(3) non-profit organization. The Store is operated to raise awareness and funds to support the Foundation’s charitable mission, including programs focused on mental wellness, youth empowerment, and scholarships. All sales and revenue generated from the Store contribute directly to the operation and expansion of the Foundation’s mission and programs.

- Products and Availability: We strive to display product colors and images accurately, but we do not guarantee that your device’s display of any color will be accurate. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.
- Order Acceptance and Cancellation: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
- Payment Terms: All prices are displayed in U.S. Dollars (USD). We accept payment via approved third-party payment gateways, including Stripe and PayPal. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Store. The Foundation does not store sensitive financial data; all payment processing is handled securely by our third-party payment processors.
- Shipping, Returns, and Refunds
- Your purchase is subject to the Foundation’s separate Returns and Refunds Policy. By placing an order, you agree to the following summarized terms:
- Return Window: Returns are accepted within 30 days of the delivery date.
- Condition: Items must be unworn, unwashed, and have all original tags attached to qualify for a refund. Worn or washed items are non-returnable.
- No Exchanges: We do not offer direct exchanges. Customers must return the item for a refund and place a new order.
- Return Shipping: The cost of the prepaid return shipping label provided by the Foundation will be deducted from your final refund amount.

- All content, design, graphics, text, logos, photographs, product designs, trademarks, and service marks on the Store and website (collectively, the “Content”) are owned by or licensed to the Ahmaud Arbery Foundation and are protected by copyright and intellectual property laws.

DISCLAIMER OF WARRANTIES: TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE FOUNDATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. - LIMITATION OF LIABILITY: IN NO event shall the Ahmaud Arbery Foundation, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of th1e site or merchandise purchased, even if we have been advised of the possibility of such damages.

- User Conduct and Termination

- Any dispute arising from these Terms or the use of the Store will be subject to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia, and you hereby consent to the jurisdiction and venue of such courts.
